Heat Pumps NOW Terms of Trade
The following terms of trade apply:
1. PAYMENT TERMS
Payment is required on completion with Credit Card details having been given prior to the start of the job, unless otherwise arranged in advance and confirmed in writing by Heat Pumps Now Ltd. For Account Holders payment is the 20th of the Following month or how it is negotiated under any separate contract.
We reserve the right to require either security or payment in advance in some cases before delivery of any particular order. Progress payments are required for new build clients. A deposit of 20% is required upon acceptance of our quote. A further 50% payment is required during the pre-line phase of the build and the final 30% payment is required following the completion of the work.
2. INTEREST AND LEGAL EXPENSES
If you fail to make a payment by the due date you shall be liable to pay us:
(a) Default interest on the amount outstanding calculated at 2% above the current banks overdraft interest rate per month, and shall accrue after as well as before judgement.
(b) All expenses, including collection costs from obtaining the services of a debt collection company and/or legal fees in relation to any overdue amount will be added to your account and you, the client are liable for payment.
3. ACCEPTANCE
Any instructions received by the HPNL from the client for the supply of goods and services, shall constitute acceptance of these terms of trade. HPNL reserves the right to decline the supply of its goods and services if it sees fit.
4. OWNERSHIP
Ownership of the goods supplied as part of this service is retained by us until payment is made in full for the goods supplied. You shall hold the goods for us as a fiduciary owner, notwithstanding, any period of credit allowed by us.
Upon default in any payment due by you to us or, either before or after any period of the credit expires, upon you becoming insolvent or having a receiver appointed or going into liquidation, we may enter upon the premises where the goods are kept and recover possession of the goods and resell the same.
5. QUOTES, ESTIMATES & VARIATIONS
5.1 All quotes or estimates are valid for 7 days, after which we reserve the right to amend if necessary to allow for price variances. HPNL also reserve the right to accept or decline any quote that falls outside it’s terms by expiration.
5.2 That the work quoted for will proceed smoothly and there are no unforeseen difficulties with the work or time delays caused by the customer or for reasons outside the suppliers control.
5.3 If additional work is required that could not be foreseen by the supplier at the time of providing the quote, then the supplier may at its option either cancel this contract or charge for such additional work at the supplier’s usual rate.
5.4 No variations to the work originally quoted for shall be carried out without the agreement of both the customer and supplier.
5.5 Where the customer and the supplier have agreed to the variation the supplier will be entitled to charge for the work involved in such variation at the supplier’s usual rate.
5.6 Where a client overrides our recommendation for placement of installations, and there are changes made at a later date, the client will be liable for all remedial costs involved with the plastering and painting etc
6. DELIVERY
Delivery shall be deemed to be completed upon installation of the goods by HPNL.
7. WARRANTY
All Heat Pumps supplied have a manufacturer’s warranty of 5 Years.
Any fault with the installation work carried out, will lead to the client notifying HPNL in writing within 7 days from the installation. This has no effect on the Manufacturer’s warranty. Please note there is a 1-year warranty cover on the installation.
8. PRIVACY ACT
8.1 The client permits HPNL collect use and retain information concerning the client, for the purpose of assessing the client’s credit worthiness or to enforce any rights under this contract.
8.2 The client permits the HPNL to disclose information obtained to any person for the purposes set out in 8.1
8.3 HPNL will comply with all requirements under the Privacy Act 2020.
9. PERSONAL PROPERTY SECURITIES ACT 1999
9.1 The client agrees that the provisions herein constitute a Security Interest in Personal Property (as those terms defined in the Personal Property Securities Act 1999 (“PPSA”) in respect of which the HPNL may register a financing statement on the Personal Property Securities register.
9.2 The client hereby waives its rights contained in sections 116,119,120(2), 121,125,126,127,129,131 and 132 of the PPSA.
10. CANCELLATION
10.1 HPNL may cancel these terms & conditions or cancel the Service by giving written notice. HPNL shall not be liable for any loss or damage arising from such cancellation.
10.2 The client may cancel services at HPNL’s sole discretions and will be liable for any costs incurred by HPNL
11. HEALTH & SAFETY
HPNL will be responsible for their own safety and health. HPNL must comply with the Health and Safety at work 2015, any regulations made under the Act, and any health and safety policies, directives or procedures of the business.

“HPNL” means Heat Pumps Now Ltd
“Client “means the person, authorised agent or legal entity described in the application, or stated on the invoice or order form/ quote, buying goods and services from Heat Pumps Now Ltd
“Services” shall mean all services supplied by the contractor to the client and includes any recommendations & advice.
